Terms of Service

These Terms of Service ("Terms") govern your use of the software products, websites, and services provided by Efficienex LLC ("Efficienex," "we," "us," or "our"), including but not limited to Revyu (accessible at getrevyu.com and app.getrevyu.com). By using our services, you agree to these Terms.

1. Description of Service

Revyu is a Software-as-a-Service (SaaS) platform that helps small businesses collect customer reviews, manage appointments, and communicate with their customers via automated SMS text messages and email.

2. SMS Messaging Program — Terms and Conditions

How to opt in:

End customers of Revyu-powered businesses may opt in to receive SMS messages by:

• Checking a consent checkbox when booking an appointment on a Revyu-powered business's site.
• Verbally or in writing providing consent to a business owner or agent, who then adds their number.
• Texting SUBSCRIBE, START, YES, or CONFIRM to (813) 544-0054.

How to get help:

Text HELP to (813) 544-0054, or email support@efficienex.com.

How to opt out:

Text STOP to (813) 544-0054 at any time. You will be automatically unsubscribed and will not receive further messages from that business unless you opt in again.

Additional opt-out keywords accepted:

CANCEL, QUIT, STOP, OPTOUT, UNSUBSCRIBE, STOPALL, REVOKE, END.

Carriers:

Carriers (including but not limited to AT&T, T-Mobile, Verizon, Sprint) are not liable for delayed or undelivered messages.

3. Account Registration

To use Revyu, you must:

• Be at least 18 years old.
• Own or be authorized to represent the business you are registering.
• Provide accurate and complete information.
• Maintain the security of your login credentials.

4. Business Owner Responsibilities

If you use Revyu as a business owner, you agree that:

• You have obtained explicit consent from each customer before adding their phone number for SMS.
• You will not use Revyu to send unsolicited messages, marketing content unrelated to your business, or content prohibited by law.
• You are responsible for the content of all messages sent from your account.
• You will comply with all applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and CTIA guidelines.
• You will honor opt-out requests promptly.

5. Prohibited Uses

You may NOT use Revyu to:

• Send SMS or email to individuals who have not opted in.
• Send content related to sexually explicit material, hate speech, harassment, illegal drugs, firearms, gambling, or any illegal activity.
• Impersonate any person or business.
• Attempt to reverse-engineer, decompile, or exploit the service.
• Send messages that violate TCPA quiet hours (before 8am or after 9pm in the recipient's local time zone).

6. Subscription and Payment

• Revyu is a paid subscription service billed monthly via Stripe.
• Fees are as listed on getrevyu.com at the time of subscription.
• Subscriptions renew automatically each month until canceled.
• Customers may cancel at any time from within the Revyu dashboard. Cancellation takes effect at the end of the current billing period.
• Refunds are provided at Efficienex's sole discretion.

7. Intellectual Property

All software, design, trademarks, and content of Revyu and Efficienex are the exclusive property of Efficienex LLC and are protected by copyright and trademark law. You are granted a limited, non-exclusive, non-transferable license to use Revyu as described in these Terms.

8. Data and Privacy

Your use of Revyu is also governed by our Privacy Policy. Business owners retain ownership of their customer data. Efficienex retains a limited right to process this data for the purpose of providing the service.

9. Service Availability

We strive for high uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience unexpected outages. We are not liable for damages resulting from service unavailability.

10. Termination

We may suspend or terminate your account if you violate these Terms, engage in illegal activity, fail to pay, or repeatedly violate SMS consent rules. Upon termination, your data will be deleted according to our Privacy Policy retention terms.

11. Disclaimer of Warranties

Revyu is provided "AS IS" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Efficienex LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of Revyu. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Efficienex harmless from any claims, damages, or expenses arising from your use of Revyu, your violation of these Terms, your violation of any law, or your infringement of any third-party rights (including TCPA violations resulting from failure to obtain consent).

14. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in the state or federal courts located in Hillsborough County, Florida.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email to active account holders and posted on this page with an updated "Last updated" date.
